Sewer System Rate Users Outside Boundary

Requires cities or towns setting sewerage system rates for owners of property outside the boundaries of the city or town, if the owners comprise more than 50% of owners of property receiving the sewerage system service, to base the rates on the actual cost of providing the service. Prohibits cities or towns from imposing arbitrarily higher sewerage system rates on owners of property located outside of the city or town or from discriminating against such owners solely on the basis of the location of their properties. Requires a city or town to conduct a public hearing prior to fixing, changing, revising, or imposing a revised sewerage system rate on owners of property located outside the boundaries of the city or town. Allows certain persons affected by
sewerage system rates to challenge the rates in court.

Requires a representative from the field of domestic violence to be a part of a local interagency oversight group in a collaborative
management program of multi-agency services provided to children and families, if such a person is available.

Expand Film Production In Colorado

Creates the Colorado office of film, television, and media (office) within the Colorado office of economic development. Specifies that the
office shall have a director and a staff to fulfill the mission of the office. Establishes the duties of the office. Creates the Colorado office of film, television, and media operational account cash fund, and specifies the purpose of the fund.
For income tax years commencing on or after January 1, 2009, but prior to January 1, 2014, establishes the Colorado film production tax
credit. Specifies that the office will allocate the credits by issuing credit certificates to production companies that produce films in Colorado. Specifies the maximum value of the credit. Limits the aggregate sum of credits allocated on an annual basis to a specified amount. Allows the credit to be carried forward to other income tax years for a maximum of
3 years. Establishes the transferability of the credit. Grants the department of revenue rule-making authority.

Authorizes the state to enter into one or more lease-purchase agreements for development and construction of a building for offices for
the department of corrections.

Authorizes carriers providing individual and group health coverage plans in this state to offer incentives for covered persons and groups to participate in wellness and prevention programs (programs). Permits
those incentives to include premium discounts or rebates; modifications
to copayment, deductible, or coinsurance amounts; or a combination of those incentives.

TIF Exception Emergency Services

Provides that, if the first property tax year in which the excess of any payment of property taxes is allocated and paid into a special fund in connection with tax increment financing by an urban renewal authority commences on or after a specified date, no portion of any revenues from such excess that are allocated to any special district providing emergency
services, including ambulance districts, fire protection districts, and certain metropolitan districts, shall be collected and paid into the special fund. In such cases, specifies that all revenues collected from the excess of any payment of property taxes shall be distributed to the special districts providing emergency services as if there were no requirement to
pay the excess into a special fund.

Conservation Easement Oversight

Eliminates the cap on the amount of the fee paid to the division of real estate (division) by:
! An appraiser in connection with submitting an appraisal for review; and An entity that holds a conservation easement in connection with an application to be certified. Requires conservation easement holders to pay an annual fee to cover the costs of the division in reviewing appraisals of conservation easements and certifying entities that hold conservation easements. Authorizes the division to also accept and expend gifts, grants, and donations to cover such costs. Repeals the provision specifying that the certification of a conservation easement holder is effective for a 3-year
period.

Conduct Of Primary Elections

Requires a designated election official, if there is not more than one candidate of a major political party who has been nominated for a
particular office on the primary election ballot, to cancel the primary election for that nomination and declare the candidate the party nominee
for that office at the general election.

Driver’s License Temporary Presence

Authorizes a person who is domiciled in another state but is employed in Colorado to drive in Colorado on the person’s existing license. Authorizes a person who is lawfully present and employed in Colorado for no more than 180 days under a work visa or similar document to drive in Colorado on the person’s existing license.

CWCB Water Efficiency Grant Fund

Gives the Colorado water conservation board (CWCB) the authority to spend moneys transferred from the operational account of the severance tax trust fund to the water efficiency grant program cash fund, which were encumbered in a prior fiscal year, and to allow such moneys to be carried forward into future fiscal years. Allows such moneys to be charged against the appropriation from the year in which the funds were originally encumbered. Gives the CWCB the authority to expend unspent moneys from the prior fiscal year that revert to the water efficiency grant program cash fund.

Cat Identification Law For Cities

Requires the owner of a cat that is 4 months or older to ensure that the cat has a form of identification on or in its body. Establishes forms of acceptable identification. Prohibits unauthorized persons from removing a cat’s identification. Permits a city to enforce the identification provisions. Requires revenue from fines related to violations of the identification provisions to be used by a city for animal-related purposes.

Low-power Self-propelled Vehicles

Replaces the current categories of self-propelled vehicles of “motor-driven cycle”,
“motorscooter”, and “motorized bicycle” with “motorcycle” and “low-power scooter”. Applies substantially similar requirements to such vehicles. Defines “low-power scooter” as a vehicle with less than 4 wheels, no manual clutch, and a power capacity not exceeding either 50cc or 4,476 watts. Conforms the definitions of “motorcycle” and “toy vehicle” to categorize the vehicles.

Yield To Transit Bus Entering Traffic

Requires drivers of vehicles behind a transit bus to yield the right-of-way to the bus if:
The driver of the transit bus, after stopping to allow passengers to board or exit, is signaling an intention to enter a traffic lane; and
A yield sign on the back of the transit bus is illuminated when the driver of the bus is attempting to enter a traffic lane.

Allows clean technology companies and medical device companies that are headquartered in Colorado and that employ 50 or fewer employees (clean technology and medical device companies) to receive refunds of state sales and use taxes paid on the sale, storage, use, or consumption of tangible personal property used in Colorado directly and
predominately in research and development of clean technology or medical devices during a calendar year (tax refunds).

Clarifies that a vendor that participates in the postsecondary and workforce readiness assessments pilot program (pilot program) shall
provide to the department of education (department) information concerning administration of the vendor’s assessments in Colorado. Removes the restriction that a local education provider participating in the pilot program (participating LEP) will assess students only in spring semesters.
